Welcome to this edition of the FP Snapshot on Manufacturing, where we take a quick snapshot look at recent workplace law developments and examine how they impact employers in the manufacturing industry. In this edition, we’ll discuss how a recent partnership between the National Labor Relations Board (NLRB) and the Occupational Safety and Health Administration (OSHA) will impact manufacturing employers.

What Happened?

Employers need to prepare for increased safety and health enforcement efforts from NLRB and OSHA after the two federal agencies announced on October 31 that they agreed to enhance information-sharing and cross-agency consultations, training, outreach, and education. The agencies aim to promote safe and healthy workplaces and protect workers who speak out about unsafe working conditions.

This agreement aligns with the recent interagency collaboration we’ve seen from the NLRB, which means employers may find themselves subject to even more scrutiny from multiple agencies. To learn more about this collaboration, you can read our full Insight here.

ASSP president will help dedicate Triangle Fire Memorial

PARK RIDGE, IL (Sept. 27, 2023) — The American Society of Safety Professionals (ASSP) is anchored to the Triangle Shirtwaist Factory fire that killed 146 garment workers in New York City more than 100 years ago. ASSP President Jim Thornton will join Acting Secretary of Labor Julie Su, New York Governor Kathy Hochul and other dignitaries in honoring those workers on Oct. 11 when a memorial is dedicated at the original building in Manhattan. The event will take place from 11:30 a.m. to 1 p.m. ET.
The Triangle fire revealed great negligence in worker safety when the tragedy occurred on March 25, 1911. A few months later came the creation of the United Association of Casualty Inspectors, now known as ASSP, the world’s oldest professional safety organization. Click HERE for the full press release.

2023 NJASSP Hispanic Heritage Event

The NJ Hispanic Outreach celebrated the 1st day of Hispanic Heritage Month. We had a lot of fun at our first September Meeting on September 21st (Fall Protection/ Restraint ANSI Z-359) with our friend and mentor Jorge Otalora. It was a great presentation, good discussion, networking and delicious food. I can’t tell you how humbled and honored I am to be at this juncture in my ASSP journey.

Thank you all that joined us last and we are looking to seeing you all at the October meeting at Picatinny Arsenal.

OSHA Announces Aggressive Plan to Address Workplace Safety in 2023: 6 Tips for Employers

Federal workplace safety officials just issued a press release announcing new enforcement guidance to make its penalties more effective in, as they describe it, “stopping employers from repeatedly exposing workers to life-threatening hazards or failing to comply with certain workplace safety and health requirements.” According to OSHA’s January 26 press release, the goal of this new guidance is to save lives, target employers who “put profit over safety,” and hold employers to greater accountability for safety and health failures. Below is a summary of the key points from the press release and six tips for employers to help maintain good workplace safety practices as OSHA turns up the heat on inspections and citations.
